Buying And Selling a Home During a Credit Crunch

As President Obama is taking office, many people who had hoped to buy a home in 2008 or 2009 are stressing as to whether a bank will be found, which will finance a home purchase.

The TARP bill (Troubled Assets Relief Program of 2008) was intended to secure bad assets in our banking institutions, in order to permit banks to open their vaults once again and issue new loans. Four months down the road, banks are still holding onto their cash in a miserly way.

Contrary to most Americans and my fiscally conservative roots, I supported the passage of the TARP bill. I honestly believed that once the federal government secured the bad debt on the books of various banks, the banks would start loaning money again for commercial loans, new car loans and home mortgages.

  • All around us, businesses are going under because they cannot secure the loans they need to buy inventory or to pay staff during the production cycle.

  • The automotive industry is suffering for two reasons, one because their cars don't get good enough gas mileage, but more importantly, because consumers cannot get auto loans.

  • Homeowners who need to sell homes cannot sell, because there is no one around who can get a home loan. Even those individuals with really good credit are having a hard time finding a bank, which will loan on a home purchase today, except in certain small pockets around the country.

  • For those individuals who have taken a new job in a far-off location, owning a home in two cities is a very daunting situation. But in the current real estate market, the owner of two homes has to consider letting one home fall to foreclosure, because it looks like the current financial crisis could continue for several more years.

  • The TARP bill passed, money was given to troubled banks, and we taxpayers got screwed. Along with many others - including the likes of Donald Trump - I was wrong. We underestimated the self-serving idiocy of the people who run our banking institutions.

    Instead of using TARP money to secure the financial well being of their banks, the banking managers bought competing banks, remodeled their bathrooms, threw extravagant parties and gave themselves huge bonuses!

    The credit crunch is still deeply entrenched in the United States and around the world. If TARP was unable to fix the credit crunch, I can only surmise that we will have a long and difficult, economic road in front of us all.

    But What If You Need To Sell A Home Now?

    Home sellers who need to sell a home now, and homebuyers who want to buy a home now, likely have only one option open to them, during this financial crisis. Interestingly, the option for home sellers and homebuyers is exactly the same - FSBO homes, or in layman-speak, For Sale By Owner homes.

    As a home seller, FSBO can seem quite scary, but it shouldn't be scary. As a seller, you have options available to help ensure that your buyer will stick to the path of righteousness.

    As a seller, it is important to remember that you have something that someone else wants. And so long as there is someone out there that wants to own your home, you have the leverage to ensure that you will get the terms that you want in the transaction.

    If you are wise, you will ALWAYS have your attorney review any paperwork in relationship to the sale of your home.

    It must be noted that many mortgages have what is called a "Due On Sale Clause" in the paperwork. In essence, what this means is that your bank or mortgage holder has the "option" to call the mortgage "due in full", when you sign interest in your property to a third-party. It should also be noted that if you sign a Lease With The Option To Buy with a third-party, and you do not tell your bank, then this amounts to fraud and is a federal crime.

    With the legal issues on the table and known upfront, we can go to the next step. The "Due On Sale Clause" in your mortgage paperwork is only an "option" that a bank holds in a property, to ensure that they get paid what is owed to them. Basically, that clause is in the mortgage paperwork to ensure that if payment to them stops, then they still have the right to evict the lessee and take over the property.

    BUT - and this is very important to realize - just because your mortgage has a "Due On Sale Clause" in it, does not mean that your mortgage holder will not authorize you to do a Lease To Own or FSBO agreement on your home. The Due On Sale Clause is an option that banks have, but banks do not always automatically take advantage of that option.

    You have to put yourself in your banker's shoes to understand why they would not force the "Due On Sale Clause" on your mortgage.

    If you still owe, let's say $60,000 on your $100,000 home, the bank stands to lose as much as $30 or $40,000 if they have to foreclose your home. When banks foreclose homes, they have to sell the homes as soon as possible at auction. But, homes typically sell at auction for as little as 20 to 40 cents on the dollar. So if you still owe more than 40 cents on the dollar against your original mortgage, chances are that the bank will lose a ton of money, if you force them to foreclose your home.

    Banks as a rule - and more so in the current economic crisis - are typically more interested in having the house "paid off in full" than forcing a homeowner into taking more drastic actions, like deciding to let the bank to foreclose on the property. More often than not, the bank will permit the FSBO arrangement, on the condition that they continue to receive all monthly payments on time.

    As a result, many banks will permit you to bypass the Due On Sale Clause, if you are willing to speak to them directly about the possibility. But, you have to open your mouth and talk to your banker, and then you need to get all of the legal agreements necessary to protect your interest and the bank's interest in your property.

    Talk first to your banker, then talk to your attorney and have the paperwork drawn up on a Lease with Option To Buy or other For Sale By Owner arrangement. With the appropriate permissions gained and the appropriate legally-binding paperwork in hand, you are now set to sell your home FSBO.

    In most cases, your buyer will lease your home on yearly renewals, and then the moment they can secure a bank loan of their own, they will buy out the lease, permitting you to escape the mortgage on that home and permitting them to transfer the property into their own name.

    Are You Seeking To Buy A Home?

    People, who are serious about selling their home now and not holding that home until the financial crisis has ended, have started to get creative about how to sell their homes.

    If you see a home listed as For Sale By Owner, chances are that the home seller has already taken the above-described steps to ensure that they will be able to sell their home now.

    So, if you have a down payment available and you want to buy a home now, it may be in your best interests to seek out FSBO homes in the area where you wish to buy.

    A friend of mine recently bought a quarter million dollar home under a Lease with Option To Buy agreement. Before the financial crisis, he had been waiting to find the perfect home, and in the current economic market, he was able to find the exact home he wanted to buy for the exact money he desired to spend on the purchase of his dream home.

    The best thing about the Lease with Option To Buy is that you are only locked into the home for generally one or two years at a time, and if you decide that you would like to secure a home mortgage after the banks have started loaning money again, then you have the option to pay the homeowner the amount of money owed to take full ownership of the home.

    We Cannot Afford To Wait Until The Banks Fix Their Mess

    With the TARP bill, it was assumed that the banks would take the money from the federal government and fix the broken credit system. Unfortunately, the bankers screwed us and only fixed their personal bank accounts.

    So, until the credit system magically fixes itself, we the consumers need to take matters into our own hands and get our own financial houses in order - no pun intended. If we are selling a home, we need to take action to get that home sold. And if we are trying to buy a house, seek out those people who are most motivated to sell you their home - look for that FSBO sign in front of the house or that FSBO ad in the newspaper.

    Let us fix our economic system one FSBO at a time, and maybe we will be able to shorten the financial crisis that our politicians seem unable to fix for us.

    An Easy Way to Secure More Registrations for Your Event

    Have you ever come across an event that you wanted to attend but registration wasn't available yet? What did you do? Did you remember to go back in a few weeks to register or just forget about it?

    If people are starting to think about registering for your event and you don't have a way to capture that interest, you are losing potential registrants. Seizing every opportunity to make a sale is critical to a successful event, especially during a time when people are spending less.

    Use A Save-The-Date Form

    A Save-The-Date form is a simple form designed to collect contact information of people interested in attending your event before registration opens. Once you have the email address and/or phone number of people interested in attending, you can proactively follow up to encourage them to register.

    A side benefit of the Save-The-Date form is the number of responses you get may help gauge the interest level for your event.

    Over the last few weeks of 2008, while the ePly team was snowed in, we brainstormed what a really good Save-The-Date form should include:

    1. Keep it simple and easy to complete.

    2. Limit the fields to name, phone number and email address; ask for other details only if you really need them.

    3. Make email address the only required field.

    4. Give clear and easy-to-read instructions on how the save the date form works such as "Registration for the "event name" is not yet open. Please enter your name and email address below and we will contact you once registration opens".

    5. Have a privacy policy on the form so people feel safe providing their information.

    6. Make the form branded to match your organization or the event, so people feel comfortable.

    7. Put the name, phone number and email address of a contact person on the form. You probably won't get many calls, but just knowing that there is someone to contact will help make your form seem more legitimate.

    The next time people express interest in your event and you are still finalizing the details, make a Save-The-Date form a part of your event marketing plan and proactively follow up to secure those registrations.

    Why You Should Edit Teleseminar Recordings - and How

    For years, I led single-session teleseminars and sold them as products without doing any audio editing. The recording service I was using created the recordings for me so they started with my "Hello" and ended after my "Goodbye," and contained everything that happened in between.

    When I shifted from offering one-off teleclasses to multi-session classes, however, I raised my standards. After all, people were paying $795 to $997 now and not just $39.95. And once I experienced how easy audio editing can be, I was no longer willing to deliver unedited audios to paying customers. It took me all of 10 minutes to learn the basic moves needed to polish an audio recording - and I am not a "techie"!

    What I do now is retain the spontaneity of a teleclass, which resembles either a radio talk show or an informal lecture, depending on whether there's just one speaker or two. But as far as I can with my elementary knowledge of audio editing, I also do the following:

  • Delete distracting beeps, coughs and static.

  • Cut at least some of the "ums" or other vocal filler.

  • Even out volume differences between speakers, making the soft voices louder and the loud ones less jarring.

  • Eliminate questions and answers that derail the flow of the session, like, "Sorry, I came late, can you repeat such and such?"

  • Make sure you check and make sure that the audio track plays in both stereo channels. Otherwise someone listening on earphones hears the sound only in one ear. I have returned two audio products for refunds because of this flaw - which is simple to fix during the editing process if you take a few moments to do so.

    Just a little more advanced in technique is adding a musical intro and outro. (The latter usually matches the former and goes at the end of the audio file.) To stay on the right side of the law, don't use snippets from commercial CDs for this. Instead, search for "royalty free music" and follow the terms of use imposed by its originator or vendor.

    Once you know your way around audio editing, you can also easily combine recordings, substitute parts of recordings or split a long teleseminar session into smaller pieces that you parcel out a day at a time in an autoresponder or on a blog. The possibilities are endless!

    Audacity, a widely acclaimed audio editing program, is not only extremely easy to use but also free. Look for it at http://audacity.sourceforge.net. I use Wavepad, another free audio editing program, available at http://nch.com.au/wavepad. If you're familiar with highlighting and moving text around a document by cutting and pasting, you'll catch on very quickly to the fundamentals of audio editing. Save your edited audio files as MP3s and you have a product that's a cut above those who distribute unedited teleseminar recordings.

    Customers usually won't demand their money back if you skip editing, but they definitely are more likely to buy again if you put some time and care into preparation of your recording.

    How To Get Feedback From Colleagues That Makes Sense

    Okay, you've just written a new website, or a new sales page. Or maybe you've just created a new product or offer. Or even just tried on a new suit.

    And you turn to your friend and ask: "Can I get some feedback from you? What do you think?"

    So they tell you what they think. They tell you, "It's nice." or "I like it." Or, if they don't like it, you get the laundry list of all the things you need to change, including the color you used around the border that you are actually in love with.

    They mean well. They want to help. But, the feedback isn't helpful.

    Statisticians and pollsters know what the problem is.

    Anyone who has studied statistics or polling knows one thing really well: that the question determines the type, and validity, of the answers you get.

    Several years ago, a friend of mine was finishing up her doctoral work in psychiatry. She was working on a research paper that included gathering information from over 100 families through the use of a questionnaire.

    How she sweated over that questionnaire! If she got the questions wrong, then her answers wouldn't be statistically valid, and all of her efforts would've been wasted.

    Luckily, you aren't conducting scientific research.

    And yet, the answers you get are just as important. If you get the wrong feedback on a website or an offer you are making, it could have a big impact on your business.

    Your first step, never ask for "feedback."

    And that's only the first on the list of 'no-no's'.

    Here are the top questions NOT to ask when you need real answers and information from people:

  • Can I get your feedback?

  • What do you think of X?

  • Tell me if you like X?

  • What's wrong with this?

  • What should I change?

  • These are the most common questions asked, but they will not get you what you want. Why not?

    You're making them work too hard.

    These questions are asking for answers. And you don't want answers, not from your friends. No really, you don't.

    I don't mean that your friends don't have good ideas. They do. But, if you ask one of those questions I've listed above, it means they mentally shift into 'expert' mode, and start looking to fix it for you.

    For instance, if you're wanting feedback on your website, you want to know how your average person is going to use it. And most people navigate a website with a certain unconsciousness- they just click and read and click some more.

    But, if you have someone in 'expert' mode, they start scrutinizing every detail intently. You lose their honest, intuitive, first-blush feedback, which is really what you're looking for.

    That kind of honest feedback comes from a place of curiosity and openness. And curiosity is much more associated with questioning, than knowing.

    That's right, ask for questions, not answers.

    An additional benefit that comes with asking for questions means that friends that aren't experts can still contribute. Someone who might go blank when asked for 'feedback' can still come up with questions that can change everything for you.

    So how do you ask for questions?

    Hmmm... perhaps I have an answer for you. Let's keep going:

    Keys to Getting the Right Questions.

    Get clear on what you're needing from them.

    Are you wondering about whether your website is easy to use? Or are you worried that the text is confusing?

    Do you think your price is too high? Or too low?

    If you don't get clear on what you are needing, and why you are needing it, how can you expect to get useful feedback from whomever you ask?

    Ask for questions around that focus.

    If someone asks the right question, you find the answer within, usually. You'll want to them ask questions asking specifically for questions:

  • "When you read my offer, what unanswered questions come up for you?"

  • "When you get to the home page of my website, do you have any questions or frustrations that pop up?"

  • "When you hear the price, do you start wondering about anything?"

  • Ask these kinds of questions, and you'll notice that your audience suddenly starts coming up with all kinds of really useful questions for you.

    Don't worry if it's a little artificial.

    It is. Even asking for questions is going to bring an unnaturally intense scrutiny to the situation. And yet, by asking for questions, you drop that extra burden of trying to find answers. The openness that comes from the questions will engender an entirely different level of conversation with them, and within yourself.

    Whether you are with your business partner, in a staff meeting, in an online forum or community, or just hanging out with friends and colleagues, try asking for their questions. See what they come up with, and write them all down.

    And then take those questions into your heart, and see what answers you discover. I bet you'll be surprised.

    Get the Balance Right

    One of the questions I get most regularly from associates throughout our company is "how do I build a successful business and maintain a quality family life?" I don't believe there is one perfect answer to that question because people's circumstances and attitudes on this subject can vary substantially. I do think, however, there are some common sense things which my wife, Cindy, and I have done over the years to give us simultaneously a great family and business life.

    First, you have to decide which is your top priority: your family or your business. That sounds like a simple question, but many people haven't totally committed to a quality marriage and family life. Once you determine your family is your absolute priority then you will always build the business around your family life and not your family around your business life. After making that decision, it is a matter of communication between spouses, and structuring and planning your time.

    For years Cindy and I worked side by side in the office. Prior to the school years, we had our children there with us. As we worked on different things we would hand them back and forth to each other. When the kids were at the office during the day, we had a play area for them and they had a thousand aunts and uncles on the team who helped us with them. Even though I was in the field on weeknights and Saturdays, Cindy was very diligent in keeping me in the loop about every aspect of our children's lives. Regularly she would tell me when I needed to take some time with any of our three children. I was always willing to move appointments around or otherwise clear some time to keep our family happy and well. Anyone who tells you that you can't build a big business and have a great family life is wrong. It won't always be easy but what worthwhile thing is?

    Someone once told me that some things in life are critical and other things are important. The business is important, but your family's welfare is critical. I love and enjoy the insurance and financial services business, but nowhere near as much as our faith or our family. It's easy to get caught up in the competition, the desire for recognition, making money, and think that is really important, but nothing contributes more to personal happiness than a great family life. A powerful and true story I heard at a church conference was of a father-son fishing trip. The father was a busy and successful businessman and cleared a day to be with his young son. Several days later, his wife read their individual journal accounts. The father's entry said words to this effect: "I went on a fishing trip with my son, waste of a perfectly good day." The son's entry went like this: "I went fishing with my Dad today, probably the best day of my life." Our time here on Earth is short and our time with our children is even shorter. With all the stress and fast pace of life today, it is vital to keep in mind how much quality time means to our loved ones. You have to schedule it and do whatever it takes to make it happen. It will often mean far more to them than you realize.

    One word of warning about striving for perfect balance, you'll never quite get there. Don't put so much pressure on yourself. Just keep working on it from day to day. Learn from your mistakes and experiences and just remember to keep your family first. With that priority as your true North you can weather the storms and crazy times that come when you commit to build an excellent life. Work hard and make it happen!

    The Power of Thinking BIG

    "Imagination is more important than knowledge." I believe no truer words were ever spoken and they were said by one of the greatest minds in the history of humanity. Albert Einstein knew a thing or two about imagination. His ability to think beyond convention, to question authority and the conclusions of scientists who came before him, gave our world some of the most significant scientific theories and discoveries of our time.

    Imagination is one of the world's greatest forces. Human beings have progressed and developed in direct relationship to their collective imagination. All of our world's greatest achievements were once just thoughts in the minds of people who dared to dream them.

    When I travel I'm always amazed by the efficiency of airlines. They get a bad rap from time to time, but when you really think about all that goes into it, it truly is amazing. What imagination there had to be to have the first flight take place? Each phase from man's first flight to the multidimensional concept of air travel had to be taken as an idea in someone's imagination before it could become a reality. Like all visionaries, those who dared to conceive had to break through the limited thinking of those around them and declare something like that possible. Leonardo da Vinci, one of the world's greatest thinkers, inventors and artists, drew elaborate drawings of flying machines all the way back in the 15th century. It has been written that he created a machine that did fly, but the religious leaders of the day labeled it an instrument of evil and made him destroy it.

    The most dynamic aspect of imagination is the act of forming mental images of what does not yet exist in our world. Another level of imagination is creating a new idea or combination of ideas stimulated by and based on previous experiences. But there is something I refer to as creative imagination that takes us a step further than just forming mental images. Creative imagination spurs action—it causes things to come into existence. When we are creatively imagining something, we are actually causing it to come into being because it has been formed for the first time in our minds. Our images contain creative power. Our thoughts are like magnets, literally drawing to us that which we think about with passion or emotion.

    In order to achieve your dreams you have to suspend disbelief and allow yourself to dream and do it on a repetitive basis. Shakespeare said, "All the world's a stage. And all the men and women merely players." He was a master at creating a theater in the mind; with patrons of his plays suspending disbelief for a few hours to believe what they saw on stage was true. The same happens to people when they go to a movie. You know what you're seeing is fictitious, but you suspend disbelief in your mind for those two hours and feel all the emotions as you're watching the movie as if it were real. The same is true with your imagination. If you would suspend disbelief and allow your mind to go to positive places, thinking about what you want to be present in your own reality, if you think about those things with enough feeling and enough belief, you begin to manifest them in your life.

    I truly believe your thoughts rule your world. That's why you need to be very careful about what you think about. Most people think about what they don't want, what they're afraid of, or what they can't do. They focus on the negative, and guess what? They likely to lead a very unhappy, unfilled life filled with anxiety rather than achievement. Whatever you think about, your world eventually becomes.

    One of the challenges is the way most people are programmed to think. The majority of the messages we receive when we are very young involve conformity, and most people end up programmed that way. As a child, you were taught to obey or suffer consequences. So it's little wonder that when most people reach adulthood, the majority choose to perpetuate conformity as the easiest and most expedient approach to life. We prefer not to rock the boat because our need for approval is usually far stronger than our desire to do something great.

    I personally believe that conformity is one of the greatest psychological evils of human kind. Not saying that there are not some rules for the sake of civilization that need to be followed. I'm talking about conformity that breaks a person's spirit—that takes away a person's capacity to dream a better life for themselves and have the drive to achieve it. The need to conform, to get approval from others, usually becomes the far greater need in our mind over achievement and doing something great. The person caught in this destructive habit never does anything worthwhile with his or her life. He wants to do something great, be independent and do important things, but he can't. His need to always be approved of prevents him. The conformist is filled with the need for approval and he or she can never get enough. He runs from one person to the next seeking compliments and endorsements for his behavior and or actions. As a child, he or she probably turned to teachers. When he started to work, he turned to his boss and fellow workers, and in marriage he turned to his mate. The conformist must always have someone around him to pat him on the head and tell him when he's doing a good job. This bolsters up his poor self-esteem. By constantly seeking approval, he escapes from the responsibility of creating his own success and happiness and becomes totally dependent on others for his well being.

    In order to be leader, a trailblazer, you have to break away from conformist thinking.

    If you were to take an assessment of how you think, are you more interested in approval from others and conforming (i.e. an average, ordinary life and average, ordinary existence) or are you interested in achieving something great? If you're going to aspire to do something great, to lead people, and make something significant happen in your life, then you have to drop every part of your desire to be a conformist. And the problem is conformists probably surround you. You may be married to one, surrounded at your job by some, and even parented by conformists. Your need for their approval needs to diminish if you want to make your dreams come true. In my opinion, the opposite of bravery is not cowardice; it's conformity.
